What the Form Covers

Why Holiday Entitlement Belongs on the Request Form

Under European Court of Justice (ECJ) case law (including rulings Kreuziger C-619/16 and Max-Planck-Gesellschaft C-684/16) and UK employment tribunal principles, statutory annual leave does not automatically lapse at the end of the holiday year unless the employer has given the worker reasonable opportunity and actively encouraged them to take their leave, with clear warning that untaken leave will be lost. Including an explicit, itemised breakdown of accrued, taken, and remaining leave directly on the request form ensures transparent record-keeping and documents that the worker has been kept fully apprised of their outstanding statutory entitlement.

Record-Keeping and Evidentiary Proof

Approved holiday request forms form an essential part of the employee's personnel file. In the event of a dispute or employment tribunal claim concerning holiday pay arrears or statutory payment in lieu of untaken annual leave on termination (under Regulation 14 of the Working Time Regulations 1998 and Section 13/23 Employment Rights Act 1996 for unlawful deductions from wages), these documented records provide vital evidentiary proof. Leave records and payroll documentation should be retained for at least 6 years in accordance with standard statutory limitation periods under the Limitation Act 1980.
