A Written Statement of Employment Particulars (commonly referred to as a Section 1 Statement) is a statutory document mandated by Sections 1 to 7B of the Employment Rights Act 1996 (ERA 1996).
Following the implementation of the UK Government's Good Work Plan in April 2020, providing a written statement is a mandatory Day 1 right applicable to all workers and employees.
Required Information in the Principal Statement
The primary statement must be delivered on or before Day 1 and must specify:
- The names of employer and worker/employee.
- The date employment began and the date continuous service commenced.
- Job title or a brief description of the work.
- Scale or rate of remuneration and intervals of payment (e.g., weekly or monthly).
- Hours of work, including normal working hours, days of the week, and whether hours or days are variable.
- Holiday entitlement and holiday pay details (including public holidays).
- Details of any probationary period, its duration, and conditions.
- Information on other paid leave (such as maternity, paternity, and bereavement leave).
- Training entitlements provided by the employer (including mandatory training).
